Supreme Court has endorsed the cassation appealed by TPI and nullified the decision of Commercial Court concerning the Bankruptcy of TPI on 14 October 2009. The endorsed cassation appeal was actually appealed not only by TPI but also by TPI’s creditors who object shall TPI held to be bankrupt. The verdict was based on the reasoning that the bankruptcy petition which was held by the Commercial Court upon the petition by Crown Capital Global Limited (“CCGL”) was not simple, meanwhile in principle, bankruptcy cases must be proven simply. From the announcement of the Supreme Court decision today, TPI is no longer holds bankruptcy status and shall run the operation back to normal. Based on that decision, the management of TPI (Director and Board of Commissioner) shall hold full authority upon TPI. We also would like to convey our gratitude to all parties that have given us their support, reinforcement and trust to TPI in managing the case.
